I. Allgemeine Geschäftsbedingungen

§ 1 Grundlegende Bestimmungen

(1) Diese Geschäftsbedingungen gelten für Verträge, die Sie mit uns, der 7-Kontinente GbR, über die Internetseite www.men-in-focus.com schließen.
(2) Unsere Inhalte sind ausschließlich für Personen ab 18 Jahren bestimmt. Mit der Bestellung bestätigen Sie, dass Sie das 18. Lebensjahr vollendet haben.
(3) Verbraucher ist jede natürliche Person, die ein Rechtsgeschäft zu privaten Zwecken abschließt. Unternehmer ist jede natürliche oder juristische Person, die bei Vertragsschluss in Ausübung ihrer gewerblichen oder selbständigen Tätigkeit handelt.

§ 2 Zustandekommen des Vertrages

(1) Vertragsgegenstand ist der Verkauf digitaler Inhalte (E-Books / Magazine als Download).
(2) Der Bestellablauf ist wie folgt:

  • Auswahl des Artikels und Hinzufügen zum Warenkorb
  • Eingabe einer gültigen E-Mail-Adresse
  • Auswahl der angebotenen Zahlungsmethode über unseren Partner CCBill
  • Bestätigung der Bestellung durch Klick auf die Schaltfläche „Jetzt kaufen“
    Nach Abschluss des Zahlungsvorgangs erhalten Sie den Download-Link an die angegebene E-Mail-Adresse.

§ 3 Zahlungsabwicklung über CCBill

(1) Die Zahlungsabwicklung erfolgt ausschließlich über unseren externen Zahlungsanbieter CCBill.
(2) Für die Zahlungsabwicklung gelten zusätzlich die Allgemeinen Geschäftsbedingungen von CCBill, die im Bestellprozess angezeigt werden.

§ 4 Nutzung und Rechte an digitalen Inhalten

(1) Sie erhalten mit Abschluss des Vertrages ein einfaches, nicht übertragbares Nutzungsrecht für den privaten Gebrauch.
(2) Eine Weitergabe, öffentliche Zugänglichmachung oder Vervielfältigung über den privaten Gebrauch hinaus ist untersagt.

§ 5 Widerruf und Rückerstattung

(1) Hinweis: Mit Beginn des Downloads erlischt Ihr gesetzliches Widerrufsrecht (§ 356 Abs. 5 BGB).
(2) Alle Verkäufe sind endgültig. Eine Rückgabe oder Rückerstattung ist nach Bereitstellung des Download-Links ausgeschlossen.

§ 6 Gewährleistung

Es gelten die gesetzlichen Mängelhaftungsrechte.

§ 7 Rechtswahl

(1) Es gilt deutsches Recht.
(2) Die Bestimmungen des UN-Kaufrechts finden keine Anwendung.

    Alle angegebenen Preise sind Endpreise und enthalten die gesetzliche Mehrwertsteuer. Es fallen keine Versandkosten an. Die Zahlung erfolgt ausschließlich über CCBill.
  6. Lieferbedingungen
    Die Lieferung der digitalen Inhalte erfolgt unmittelbar nach Zahlungseingang über einen Download-Link an die von Ihnen angegebene E-Mail-Adresse.
  7. Gesetzliches Mängelhaftungsrecht
    Es gelten die gesetzlichen Gewährleistungsrechte.

I. Terms and Conditions

§ 1 Basic Provisions

(1) These Terms and Conditions apply to all contracts concluded with us, 7-Kontinente GbR, via the website www.men-in-focus.com. Unless otherwise agreed, the inclusion of your own terms and conditions is rejected.

(2) Our content is strictly intended for persons over the age of 18. By placing an order, you confirm that you are at least 18 years old.

(3) A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who acts in the course of their trade, business or profession.

§ 2 Conclusion of the Contract

(1) The subject of the contract is the sale of digital content (e-books / magazines as downloads).

(2) The ordering process works as follows:

  • Select a product and add it to the cart
  • Enter a valid e-mail address
  • Select your preferred payment method via our partner CCBill
  • Confirm your order by clicking the “Buy now” button

After payment has been successfully completed, you will receive a download link via e-mail.

§ 3 Payment Processing via CCBill

(1) Payment processing is handled exclusively by our external payment provider CCBill.
(2) In addition to our Terms and Conditions, the General Terms of CCBill also apply and will be displayed during the checkout process.

§ 4 Usage Rights for Digital Content

(1) Upon conclusion of the contract, you receive a simple, non-transferable right to use the purchased digital content for private, personal purposes only.
(2) Any distribution, public sharing or reproduction beyond private use is strictly prohibited.

§ 5 Withdrawal and Refunds

(1) Important note: For digital content, your statutory right of withdrawal expires once the download begins (Art. 16 lit. m EU Consumer Rights Directive).
(2) All sales are final. Refunds or cancellations are not possible once the download link has been provided.

§ 6 Warranty

The statutory warranty rights apply.

§ 7 Governing Law

(1) German law shall apply. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which they have their habitual residence.
(2) The provisions of the UN Convention on Contracts for the International Sale of Goods (CISG) do not apply.

  6. Prices and Payment
    All prices shown are final prices including VAT. No shipping costs apply, as products are provided digitally. Payment is processed exclusively via CCBill.
  7. Delivery Conditions
    Delivery of digital content takes place immediately after payment has been received, via download link sent to the e-mail address you provided.
  8. Statutory Warranty
    Warranty is governed by the rules set out in § 6 of our Terms and Conditions.
